Adept Dept provides an AI image generator service that includes text-to-image, background removal, background replacement, image cleanup, text removal, image upscaling, and more. The Service is subject to these Terms of Use.

3. User Conduct

You agree to use the Service responsibly and in compliance with all applicable laws and regulations. Specifically, you must not:

3.1. Unauthorized Use

Copy, distribute, or disclose any part of the Service by any means, including automated or non-automated scraping.

3.2. Automated Access

Use automated systems like robots, spiders, or offline readers to access the Service in a manner that places an undue load on our servers.

3.3. Spam and Unsolicited Emails

Transmit spam, chain letters, or unsolicited emails.

3.4. Security Compromise

Attempt to interfere with or compromise the integrity and security of the Service.

3.5. Overloading

Take any action that imposes an unreasonable load on our infrastructure.

3.6. Malicious Content

Upload invalid data, viruses, worms, or other harmful software through the Service.

3.7. Data Collection

Collect personally identifiable information from the Service.

Impersonate or misrepresent your identity, engage in phishing activities, or create misleading links.

3.14. Framing and Hotlinking

Use framing or hotlinking to link to the Service or its content without our consent.

3.15. Illegal Content

Upload or use any content that is illegal, sexual, pornographic, includes child exploitation material, or violates these Terms of Use.

4. Use of Content

4.1. AI Image Editor Designs

You may create visual designs using our Service. Visual Designs may be downloaded/exported in various formats.

4.2. Licensing of Adept Dept Content

To export Adept Dept Content from the Service, you must comply with the licensing terms provided in the Adept Dept Terms and Conditions.

4.3. Third Party Content

The Service may include Third Party Content, and you are responsible for complying with third-party terms and conditions that apply to such content.

4.4. AI Generated Content

The Service may allow you to create, modify, or enhance designs using AI Generated Content. You agree to be bound by the AI Product Terms and Conditions when using AI Generated Content.

5. User Content

5.1. General

Some areas of the Service allow Users to upload and use content (“User Content”). You retain ownership of your User Content and are responsible for its compliance with these Terms of Use.

5.2. Uploading and Use of User Content

By uploading User Content, you agree that:

  • Your User Content must comply with these Terms of Use and all technical requirements set by Adept Dept.
  • You own the intellectual property rights to your User Content or have the necessary permissions to use it.
  • Your User Content does not violate any laws or infringe upon the rights of third parties, including Intellectual Property Rights.
  • Your User Content does not contain harmful or objectionable content.
  • The Company has a license to use your User Content as specified in these Terms of Use.

6. Intellectual Property Rights

Adept Dept respects intellectual property rights. If you believe your intellectual property rights are violated on the Service, please contact us.

7. Termination

We may terminate or suspend your access to the Service if you violate these Terms of Use or for any other reason at our sole discretion. After termination, you are still bound by these Terms of Use.

8. Modifications

We may modify the Service or these Terms of Use at any time without notice. It is your responsibility to review the Terms of Use periodically.

AI Product Terms

Effective Date: Oct 23, 2023

1. AI Product Description

The AI Products enable users (“User”) to create graphic resources using AI-powered tools provided by Adept Dept, resulting in AI-generated content (“AI Generated Content”).

2. User Responsibility

The User is responsible for any text uploaded to the AI Products (“Input”) and for the resulting material generated by the AI Products, including images, presentations, or any other graphic resources (“Output”). The User must ensure that Inputs and Outputs comply with these AI Product Terms before using or sharing them.

3. Usage Limits

Adept Dept may impose limits on the number of AI Generated Content the User can create using the AI Products. The User will be notified when the maximum number of Outputs for the User account is reached. Please note that the availability of the AI Products may vary by language.

4. Third-Party Providers

The AI Products use technology provided by third-party service providers, and the User must comply with the terms and conditions and/or license agreements of these providers, which are incorporated into these AI Product Terms by reference.

5. Use of AI Generated Content

The User may use the AI Generated Content for any legal purpose, provided it complies with these AI Product Terms. The User acknowledges that they are solely responsible for such use, and any use of the AI Generated Content is at the User’s own risk.

6. Prohibited Uses

The User agrees not to upload any Input or use any Output to:

6.1. Infringe, misappropriate, or violate the intellectual property and/or image rights or other rights of any third party.

6.2. Generate spam, false, misleading, deceptive, harmful content for any person or group, or violent imagery.

6.3. Mislead anyone that the AI Generated Content is human-generated.

6.4. Generate political content for dissemination in electoral campaigns.

6.5. Generate nudity or shocking content, including obscene gestures or other profane subjects.

6.6. Slander, libel, or vilify any person, race, sex, culture, sexual orientation, religion, country, region, town, village, or any other place, or any other human group.

7. Enforcement and Breach

If any Input or Output is alleged to be unlawful or in breach of these AI Product Terms, Adept Dept may disclose such content to law enforcement or other governmental authorities, or in response to a court order. A breach of these AI Product Terms may result in the suspension or banning of the User’s account.

8. AI Generated Content Disclaimer

The User acknowledges that AI Generated Content is generated by artificial intelligence technology. Adept Dept does not select, examine, control, guarantee, approve, sponsor, or identify itself with the AI Generated Content.

Adept Dept makes no warranty as to the legitimacy, accuracy, completeness, or reliability of the AI Generated Content and disclaims any liability or responsibility arising from its use by the User or any omissions or errors contained in the AI Generated Content. The User is solely responsible for obtaining professional and independent advice before using the AI Generated Content.

9. User Content Usage Rights

By creating AI Generated Content, the User grants Adept Dept the right to host Inputs and Outputs on Adept Dept’s platforms, publish them on the Website, make them available to other Users, and use them for marketing and improving Adept Dept’s products and services.

10. Reporting Undesired Results

The User acknowledges that, in certain cases and due to certain Inputs, the AI Products may produce undesired results. If such results occur, the User may contact Adept Dept through the support form to report them. If there is any doubt as to whether an Output may violate these AI Product Terms, the User should refrain from using it.
